HR Employment Law Update 2016

The Human Resources Roundtable held its annual Employment Law Update on January 20, and the event was a great success.  Employment lawyer Bruce May from Stuart Kane and VP of Human Resources John Armstrong from Astronics presented a Top Ten List For Employers in 2016.  Key takeaways included the following:   California has a new law forbidding sex discrimination in pay for jobs involving substantially similar work, and a new sick pay law requiring at least 3 paid sick days per year for all employees.  Employers should make sure their pay scales can be justified by legitimate factors such as skill and experience, and they should update their sick leave and vacation policies to comply with the new sick pay law. The “Ban the Box” movement seeks to remove arbitrary barriers to hiring candidates with criminal records, in light of the downsizing underway in our overcrowded prisons. Employers may soon be forbidden from asking about criminal convictions until after they make a job offer.  Challenges to independent contractor status are increasing—just ask Uber and Lyft—but employee Arbitration Agreements can help reduce the risk of class action lawsuits.   Marijuana in the workplace—medical and recreational—presents new challenges as the move toward legalization gathers steam.  Make sure you have a signed written commission plan with every commissioned employee as required by California law, and be careful with unpaid interns and volunteers.  Finally, a new California law called the Fair Day’s Pay Act imposes personal liability on owners, officers, directors, and managing agents for overtime and other employment law violations by their corporations.  This is a radical break from precedent that will dramatically reshape the risk...
